Welcome to Rush Logistics LLC. These Terms of Service (“Terms”) govern your access to and use of the logistics, transportation, delivery, freight, dispatch, and related services provided by Rush Logistics LLC (“Rush Logistics LLC,” “Company,” “we,” “us,” or “our”).
By requesting, booking, receiving, or using our services, you (“Customer,” “you,” or “your”) agree to these Terms. If you do not agree with these Terms, you should not use our services.

Our Services
Rush Logistics LLC provides logistics and transportation-related services, which may include, depending on the services requested:
- Local and long-distance transportation
- Freight and shipment coordination
- Pickup and delivery services
- Same day and scheduled delivery
- Expedited transportation
- Last-mile delivery
- Route and dispatch coordination
- Shipment tracking and status notifications
- Commercial and residential deliveries
- Other logistics services agreed upon between Rush Logistics LLC and the Customer
Specific services, pricing, pickup locations, delivery locations, timing, and other requirements may be confirmed through a written quote, order, booking confirmation, invoice, or other communication.
Rush Logistics LLC may use employees, independent contractors, carriers,drivers, or third-party service providers to perform services.

Customer Responsibilities
Customers are responsible for providing accurate and complete information necessary to perform the requested service, including:
- Pickup and delivery addresses
- Contact names and telephone numbers
- Shipment descriptions
- Number and type of packages
- Weight and dimensions, when applicable
- Special handling instructions
- Required pickup or delivery times
- Access, loading, unloading, or delivery requirements
- Any information regarding hazardous, restricted, fragile, valuable, or unusually large items
The Customer is responsible for ensuring that all information supplied to Rush Logistics LLC is accurate.
Rush Logistics LLC is not responsible for delays, additional charges, failed deliveries, or other issues caused by inaccurate, incomplete, or misleading information provided by the Customer.

Prohibited and Restricted Items
Customers may not tender items that are illegal, stolen, improperly packaged, or otherwise prohibited by applicable law.
Unless specifically approved in writing by Rush Logistics LLC, shipments may not contain hazardous materials, explosives, firearms, ammunition, illegal drugs, perishable goods, live animals, dangerous substances, or other restricted materials.
Customers are responsible for informing Rush Logistics LLC in advance if a shipment contains any item that requires special handling, documentation, licensing, labelling, or transportation procedures.
Rush Logistics LLC reserves the right to refuse, inspect, hold, return, or cancel any shipment that it reasonably believes violates applicable law, these Terms, safety requirements, or carrier requirements.

Packaging and Shipment Preparation
Customers are responsible for properly packaging and securing items before pickup unless Rush Logistics LLC has expressly agreed to provide packaging services.
Packages must be appropriately sealed, labeled, and prepared for transportation.
Rush Logistics LLC may refuse a shipment that is inadequately packaged or presents a safety risk to people, vehicles, equipment, or other property.
Unless otherwise agreed in writing, Rush Logistics LLC is not responsible for damage resulting from inadequate, improper, or defective packaging supplied by the Customer.

Quotes, Rates, and Additional Charges
Rates may be based on factors including distance, shipment size, weight, number of stops, urgency, vehicle requirements, waiting time, labor requirements, tolls, special handling, access conditions, and other circumstances.
Quotes are based on the information available at the time the quote is provided and may be adjusted if shipment conditions differ materially from the information provided.
Additional charges may apply for circumstances including, but not limited to:
- Extended waiting time
- Additional stops
- Address changes
- Redelivery attempts
- Special handling
- Loading or unloading assistance
- Oversized or overweight shipments
- Difficult access
- Tolls, parking, or other transportation expenses
- Customer-caused delays
- After-hours, weekend, or holiday service
- Services requested after the original booking
The Customer agrees to pay all applicable charges associated with the requested services.

Payment
Payment terms will be communicated at the time of booking or invoicing.
Unless otherwise agreed in writing, invoices are due according to the payment terms stated on the invoice.
Customers are responsible for providing valid payment information and authorizing applicable charges.
Rush Logistics LLC may suspend or refuse future services for accounts with overdue balances.
The Customer may also be responsible for reasonable costs associated with collecting unpaid amounts, to the extent permitted by applicable law.

Cancellations and Changes
Customers should notify Rush Logistics LLC as soon as possible of any cancellation, rescheduling request, address change, or other modification to a confirmed service.
Cancellation fees or other charges may apply depending on the timing of the cancellation and whether Rush Logistics LLC has already committed personnel, vehicles, equipment, or other resources to the shipment.
Rush Logistics LLC will communicate applicable cancellation or change charges when reasonably possible.

Pickup and Delivery Times
Rush Logistics LLC will make reasonable efforts to meet quoted or scheduled pickup and delivery times.
Unless expressly guaranteed in writing, pickup and delivery times are estimates and are not guaranteed.
Delivery schedules may be affected by traffic, weather, road closures, vehicle issues, mechanical failures, accidents, customer delays, incorrect information, facility delays, governmental restrictions, or other circumstances beyond our reasonable control.
Rush Logistics LLC will make commercially reasonable efforts to communicate material shipment delays when appropriate.

Delivery and Proof of Delivery
A shipment may be considered delivered when it is delivered to the designated address or to an authorized recipient, unless other delivery instructions have been agreed upon in advance.
Rush Logistics LLC may use signatures, photographs, electronic confirmations, GPS information, timestamps, or other reasonable documentation as proof of delivery.
Customers are responsible for providing accurate delivery instructions and ensuring that the recipient or authorized representative is available when required.

Failed Delivery and Redelivery
If delivery cannot be completed because of an incorrect address, inaccessible location, recipient unavailability, refusal of delivery, unsafe conditions, or other circumstances attributable to the Customer or recipient, additional charges may apply.
Rush Logistics LLC may return the shipment to the pickup location, hold the shipment pending further instructions, or arrange another delivery attempt.
The Customer may be responsible for applicable storage, return, redelivery, waiting, or other reasonable charges.

Shipment Tracking and Communications
Rush Logistics LLC may provide shipment updates through telephone calls, email, SMS/text messages, online systems, or other communication methods.
By providing a telephone number and opting in to receive text messages, you consent to receive transactional or service-related messages concerning your shipments, deliveries, appointments, account, or requested services.
Message and data rates may apply. Message frequency may vary.
You may opt out of SMS communications at any time by replying STOP. For assistance, reply HELP or contact Rush Logistics LLC directly.
Opting out of text messages does not necessarily cancel other communications required to complete a requested transaction or service.

Customer Authorization for Communications
By providing contact information to Rush Logistics LLC, you represent that you have authority to provide that contact information and authorize Rush Logistics LLC to use it for legitimate business and service-related communications.
Communications may include:
- Pickup confirmations
- Delivery notifications
- Shipment status updates
- Scheduling communications
- Appointment reminders
- Service-related questions
- Customer support communications
- Billing or account communications
- Other communications reasonably related to services requested by the Customer
Marketing communications, if any, will be handled in accordance with applicable consent and messaging laws.

Customer Property
Customers remain responsible for their property until it has been accepted for transportation by Rush Logistics LLC and after delivery has been completed, except to the extent responsibility is otherwise imposed by applicable law or an applicable transportation agreement.
Customers should not tender cash, negotiable instruments, irreplaceable documents, or unusually valuable property without first notifying Rush Logistics LLC and obtaining written approval where required.

Loss, Damage, and Claims
Customers should promptly notify Rush Logistics LLC of any apparent loss, shortage, or damage.
Claims may be subject to applicable federal, state, local, or other transportation laws, regulations, tariffs, contracts, or carrier terms.
Nothing in these Terms is intended to waive or limit any rights or obligations that cannot legally be waived or limited.
Where applicable, claims should include sufficient information and documentation for Rush Logistics LLC to investigate, which may include shipment details, photographs, receipts, invoices, delivery records, or other relevant evidence.

Limitation of Liability
To the maximum extent permitted by applicable law, Rush Logistics LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost business opportunities, loss of revenue, or business interruption, arising from or related to the use of our services.
Rush Logistics LLC liability, if any, will be limited to the extent permitted by applicable law and any applicable written transportation agreement, tariff, insurance provision, or other governing contract.
Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.

Force Majeure
Rush Logistics LLC will not be responsible for failure or delay in performing services caused by circumstances beyond its reasonable control.
Such circumstances may include severe weather, natural disasters, traffic conditions, accidents, road closures, acts of government, labor disruptions, civil disturbances, pandemics, utility failures, carrier disruptions, mechanical failures, or other unforeseen events.
Rush Logistics LLC will make reasonable efforts to resume or complete services when conditions permit.

Third-Party Carriers and Service Providers
Rush Logistics LLC may engage third-party carriers, contractors, drivers, vendors, or service providers to perform some or all of the requested services.
The Customer authorizes Rush Logistics LLC to use such providers when reasonably necessary to provide the requested services.
Third-party transportation services may also be subject to additional terms, policies, tariffs, or requirements.

Privacy
Rush Logistics LLC may collect and use the necessary information to provide services, process transactions, communicate with Customers, maintain records, improve operations, and comply with applicable law.
Personal information will be handled in accordance with the Rush Logistics LLC Privacy Policy.

Website and Online Services
If Rush Logistics LLC provides a website, customer portal, tracking system, or other online service, Customers agree not to misuse, interfere with, reverse engineer, circumvent, or attempt to gain unauthorized access to those systems.
Rush Logistics LLC reserves the right to modify, suspend, or discontinue online features at any time.

Intellectual Property
All trademarks, logos, text, graphics, photographs, software, website content, and other materials owned or licensed by Rush Logistics LLC are protected by applicable intellectual property laws.
Except as expressly permitted, Customers may not copy, reproduce, distribute, modify, publish, or commercially exploit Rush Logistics LLC intellectual property without prior written permission.

Customer Conduct
Customers agree not to use Rush Logistics LLC for unlawful purposes or in a manner that could endanger drivers, employees, contractors, customers, property, or the public.
Rush Logistics LLC may refuse service or terminate a transaction if it reasonably believes that continued service would create a safety, legal, financial, or operational risk.

Termination or Suspension
Rush Logistics LLC may suspend, refuse, or terminate services when permitted by law, including where a Customer violates these Terms, fails to pay due amounts, provides materially inaccurate information, tenders prohibited items, or engages in abusive, threatening, fraudulent, or unsafe conduct.
Customers remain responsible for charges incurred before termination.

Disputes
Customers should first contact Rush Logistics LLC to attempt to resolve any dispute informally.
If a dispute cannot be resolved informally, it will be handled in accordance with the laws and procedures applicable to the jurisdiction governing the applicable transaction or agreement, subject to any mandatory laws that apply.
Any dispute-resolution provision contained in a separate written transportation agreement, rate confirmation, carrier agreement, bill of lading, or other governing document may control over these general Terms to the extent of any conflict.

Changes to These Terms
Rush Logistics LLC may update these Terms from time to time.
Updated Terms will become effective when posted on our website unless a different effective date is stated.
Your continued use of Rush Logistics LLC services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.

Entire Agreement
These Terms, together with any applicable quote, booking confirmation, invoice, rate confirmation, transportation agreement, bill of lading, privacy policy, or other written agreement, constitute the applicable agreement between Rush Logistics LLC and the Customer regarding the services covered by those documents.
If there is a conflict between these Terms and a separately executed written agreement, the separately executed agreement will control to the extent of the conflict.
